Art. 105. En caso de que un funcionario de instrucción se declare impedido ó recusado para conocer de un negocio, pasará á el expediente al Alcalde del Distrito, para que califique el impedimento y avoque el conocimiento; y si dicho Alcalde también se creyera impedido ó fuere recusado, conocerán del impedimento y del asunto los suplentes del Alcalde, por su orden.
