Los cargos del Orden Judicial y los del Ministerio Público no son acumulables, y son incompatibles con el ejercicio de cualquiera otro cargo retribuido que no sea el del profesorado en un establecimiento de instrucción pública. Dichos cargos son igualmente incompatibles con toda participación en el ejercicio de la abogacía.
