Si probado el delito los testigos estuvieren contestes en las circunstancias esenciales en favor o en contra del acusado, bastará que se reciban de tres a cinco declaraciones de testigos hábiles. En seguida se recibirá la indagatoria al reo, y se procederá al examen de los .testigos presentes que citare, lo que se hará con las mismas formalidades establecidas en los artículos precedentes.
