Presentados Los Descargos, Y Practicadas Las Pruebas Decretadas Si Fuere Del Caso, Se Adoptará La Decisión Mediante Acto Administrativo Motivado

Presentados los descargos, y practicadas las pruebas decretadas si fuere del caso, se adoptará la decisión mediante acto administrativo motivado. Esta actuación se someterá a las reglas sobre vía gubernativa señalados en el Código Contencioso Administrativo.

Parágrafo

En todos aquellos casos en que la sanción de suspensión o cancelación de las habilitaciones, licencias, registros o permisos puedan afectar gravemente la prestación del servicio público de transporte en detrimento de la comunidad se preferirá por una sola vez la imposición de la multa.
