Si se concede una apelación en el efecto devolutivo y la parte considera que ha debido otorgársele en el suspensivo, puede, al llegar los autos al superior,presentarse de hecho; y si tiene derecho el recurrente, se le concede el recurso en el efecto denegado, y se dispone lo conveniente para que la admisión surta sus efectos.
