Si al tiempo de cometer el hecho se halla el militar en estado de enajenación mental o de intoxicación crónica producida por el alcohol, o cualquiera otra sustancia tóxica, o padece de grave anomalía psíquica, se le aplican las medidas de seguridad previstas en el Código Penal común.
