La decisión del Juez Penal Militar de Control de Garantías no será susceptible de impugnación por ninguno de los que participaron en ella. No obstante, si la defensa se abstuvo de intervenir, podrá en la audiencia preliminar o durante la audiencia preparatoria solicitar la exclusión de las evidencias obtenidas.
