Apareciendo en el sumario la comprobación del cuerpo del delito y de la responsabilidad del autor de él, con las pruebas que señala la ley, el Juez dictara el correspondiente auto de proceder sin dar lugar a mas ampliaciones, las que podrán verificarse en el termino de prueba.
