Competencia para la declaratoria de áreas arqueológicas protegidas . En todo el territorio nacional, el ICANH podrá declarar áreas arqueológicas protegidas y aprobar el Plan de Manejo Arqueológico correspondiente. La declaratoria de Áreas Arqueológicas Protegidas podrá hacerse

Oficiosamente por el ICANH.

Por solicitud de una entidad territorial.

Por solicitud de los grupos o comunidades étnicas reconocidas por el Ministerio del Interior, siempre que el área de la declaratoria se encuentre dentro de su jurisdicción. El ICANH evaluará la pertinencia de la solicitud de declaratoria.
