ARTICULO 83. Prohibición pago doble subsidio familiar. En ningún caso habrá lugar al reconocimiento de doble subsidio familiar. Cuando el cónyuge del Oficial o Suboficial preste sus servicios en el Ministerio de Defensa el subsidio familiar se reconocer al cónyuge que perciba mayor asignación básica, si ésta fuere igual, recibir el subsidio quien acredite mayor tiempo de servicio al Ministerio de Defensa.

Parágrafo

El Oficial o Suboficial cuyo cónyuge preste servicio en otra entidad oficial, para tener derecho al subsidio familiar pagado por el Ministerio de Defensa, deber acreditar que su cónyuge ha renunciado a dicha prestación en la entidad en donde trabaja, mediante certificación expedida por esta última.
