No pueden ser elegidos Senadores, Representantes, Diputados a las Asambleas Departamentales, principales o suplentes, en ninguna de las circunscripciones electorales, los individuos que el día de las votaciones desempeñen o hubieren desempeñado en los tres meses anteriores a éstas los empleos de Presidente de la República, Ministro del Despacho, Magistrado de las Corte Suprema, Consejero de Estado, gobernador de Departamento, Procurador General de la Nación o Jefe del Ejército que tengan jurisdicción o mando militar en toda la República.
