El funcionario o empleado público que teniendo conocimiento de la comisión de un delito, cuya averiguación deba adelantarse de oficio, no dé cuenta a la autoridad, incurrirá en multa de cinco a doscientos pesos. Si tiene conocimiento del hecho en el ejercicio de sus funciones, la multa será de diez a quinientos pesos.
