El numeral 5° del artículo 107 del Decreto 1151 de 1989, quedará así: “5. Existir proceso penal promovido por el quejoso, el acusado, sus representantes o apoderados, contra el funcionario del conocimiento o el empleado que instruya o proyecte, o contra su cónyuge o parientes en primer grado de consanguinidad, siempre y cuando dicho proceso haya sido iniciado con anterioridad a la apertura de las diligencias preliminares o de la investigación disciplinaria, según el caso”.
