Art. 405. El Jefe del Resguardo es funcionario de instruccion, en el puerto de su destino, en la bahía i en las costas respectivas, para averiguar las faltas de la misma naturaleza de las espresadas en los artículos anteriores que tengan mayor pena señalada en el Código Penal o en el presente, i como tal levantará a prevencion la sumaria del caso i la pasará al Juez competente.
