El funcionario público que, ya por su propia cuenta, ya por cuenta de un tercero, reciba por un acto de sus funciones, en dinero o en especie, una retribución que no se le debe, o que acepte promesa de hacerle un pago o entrega de ese género, será castigado con reclusión por dos meses a un año, interdicción de uno a dos años de ejercer funciones públicas, y multa de diez a doscientos pesos.
