La autorización concedida por el artículo 3°., y el derecho correspondiente a la subvención, solo se entenderán concedidos siempre que el Departamento de Santander no se halle en capacidad de acometer por sí mismo la obra dentro de su propio territorio, pues si estuviere oportunamente en tal capacidad, al corresponderá de derecho.
