Corresponderá al Alcalde o al Intendente, mediante resolución motivada, declarar la extinción del derecho de dominio de los inmuebles que no cumplan una función social, a favor del respectivo municipio, el Distrito Especial de Bogotá, o la Intendencia de San Andrés y Providencia. En dicha resolución se especificará el uso o destino que deba darse al inmueble en lo sucesivo, de conformidad con el plan de desarrollo o con el plan de desarrollo simplificado, y en defecto de éstos, de conformidad con el uso que le asigne la Oficina de Planeación Departamental.
