ARTICULO 31 . INSANCIONABILIDAD DE LA CONDUCTA. No son sujetos sancionables disciplinariamente quienes en el momento de ejecutar el hecho constitutivo objetivamente de falta disciplinaria, no tuvieren la capacidad de comprender su ilicitud o de determinarse de acuerdo con esa incomprensión, por inmadurez psicológica o trastorno mental, debidamente comprobado, siempre y cuando el agente no hubiere preordenado su conducta o no sea el resultado de un trastorno voluntario.
