° La cancelación de personería jurídica se impondrá, previo concepto de la Junta Directiva del ICFES, mediante resolución motivada del Ministro de Educación Nal, a la institución de educación superior que se hubiere apartado ostensiblemente de los fines que motivaron su creación o incumplido reiteradamente las disposiciones legales o estatutarias que la rigen. Esta sanción procederá únicamente cuando la institución haya sido sancionada con suspensión de la personería jurídica.
