Cuando las faltas a que se refieren los artículos anteriores sean cometidas en alta mar, en viaje al Exterior, o en puerto extranjero, el Comandante de la nave ejercerá las funciones de Juez Militar, y tendrá la facultad de nombrar funcionario de instrucción y Fiscal, y podrá suspender a los sindicados en el ejercicio de sus funciones y atribuciones. Iguales funciones y facultades tendrá el Comandante de la nave, en el caso de delitos cuyo juzgamiento sea de la competencia de la Justicia Penal Militar.
