Para garantizar el respeto de la voluntad legítima mayoritaria de los electores habrá lugar a declarar la nulidad de la elección por voto popular, cuando el juez establezca que las irregularidades en la votación o en los escrutinios son de tal incidencia que de practicarse nuevos escrutinios serían otros los elegidos.
