Por regla general, y salvo las excepciones consignadas en el aparte especial de este Código, las penas de presidio y prisión llevan consigo la interdicción del ejercicio de derechos y funciones públicas por un período igual al de la pena principal, y para los extranjeros, la expulsión del territorio nacional; la de presidio puede traer, además, la pérdida de la patria potestad, y la de prisión podrá acarrear la suspensión de la patria potestad durante el tiempo de la condena.
