Las penas a que se refiere el artículo anterior se aumentarán hasta el doble y la pena será de prisión cuando el hecho se comete en tiempo de guerra, conflicto armado, conmoción interior o turbación del orden público. Si el desertor se pasare a rebeldes o sediciosos, la pena será de dos a seis años de prisión.
