No están sujetos al pago del impuesto de tonelaje:

a). Los buques de guerra de naciones amigas, que descarguen simplemente productos que no estén sujetos al impuesto de aduana.

b). Los mercantes, que conduzcan inmigrantes en número mayor de cincuenta.

c). Los que obtengan o hayan obtenido la exención por tratados públicos; y

d). Los que la obtengan o la hayan obtenido a virtud de contratos celebrados válidamente con el Gobierno.
