Las circunstancias personales que disminuyan o excluyan la responsabilidad no se tendrán en cuenta sino respecto del autor u cómplice de quien incurra. Tampoco se tendrá en cuenta aquellas cuyo efecto sea agravar la sanción, a menos que hubieren sido conocidas por el copartícipe; pero en este último caso podrá disminuirse tal agravación hasta en una sexta parte.
