El funcionario, empleado público o la persona facultada para ello, que en el ejercicio de sus funciones y a sabiendas, pone en circulación moneda o papeles de crédito público emitidos ilegalmente en exceso, incurre en la prisión de seis meses a cuatro años, en interdicción de derechos y funciones públicas por el mismo término y en multa de quinientos a mil pesos.
