Decreto 2550 de 1988 · Por el cual se expide el nuevo Código Penal Militar

ABUSO DE AUTORIDAD POR ACTO ARBITRARIO O INJUSTO. El que fuera de los casos especialmente previstos como delitos, con ocasión de sus funciones o excediéndose en el ejercicio de ellas, cometa acto arbitrario o injusto, incurrirá en multa de un mil a diez mil pesos.

Parágrafo

Si el acto arbitrario o injusto se realiza por medio de las armas, o empleando la fuerza, o con violencia sobre las personas o las cosas, la pena será de cuatro (4) a doce (12) meses de arresto, sin perjuicio de que se apliquen las sanciones que correspondan por el concurso de delitos.
