Cuando el auto de proceder no fuere apelado y los procesados, siendo varios, no fueren todos llamados a juicio, o cuando haya serios motivos para temer que existen otro u otros participes del delito que aún no han sido descubiertos, se sacará copia del proceso para la consulta del sobreseimiento o la continuación de la investigación, sin suspender el juicio.
