El artículo 1026 del Código Civil quedará así: Es indigno de suceder quien siendo mayor de edad no hubiere denunciado a la justicia, dentro del mes siguiente al día en que tuvo conocimiento del delito, el homicidio de su causante, a menos que se hubiere iniciado antes la investigación. Esta causa de indignidad no podrá alegarse cuando el heredero o legatario sea cónyuge; ascendiente o descendiente de la persona por cuya obra o consejo se ejecutó el homicidio, o ascendente o descendiente, o haya entre ellos vínculos de consanguinidad o afinidad hasta el cuarto grado, o de afinidad o de parentesco civil hasta del segundo grado, inclusive".
