El que en los cuarteles, fortalezas, vivaques, naves o bases aéreas, marítimas o fluviales, o cualesquiera establecimientos militares, ya de palabra o por escrito, abierta o subrepticiamente invite o provoque a los militares, directa o indirectamente, a la rebelión, sedición o asonada, les comunique instrucciones o les indique medios, para consumarlas, cuando el delito no llegue a efectuarse, incurre hasta en dos terceras partes de la pena correspondiente al respectivo delito.
