Cuando el funcionario de instrucción recibe denuncia o cuando se encuentre en el caso previsto en el artículo 283 del Código de Procedimiento Penal común dicta auto cabeza de proceso en que, fundándose en el conocimiento que ha tenido de la infracción penal, resuelve abrir la investigaci6n correspondiente al descubrimiento de los hechos, de sus autores o participes, de la personalidad de los mismos, de los motivos determinantes, de la naturaleza y cuantía de los perjuicios, cuando sea el caso, y solicita copia de los documentos que acrediten la calidad del militar sindicado.
