De la demanda para que se dé la posesión efectiva de una herencia o de parte de ella se dará traslado por tres días al representante del Municipio o Municipios a los cuales hubiere de corresponder la herencia, en el caso de faltar otro heredero abintestato.

A la demanda debe acompañarse la prueba de la delación de la herencia a favor de la persona para quien se pide.
