ART 289. Cuando una fuerza, prescindiendo de la obediencia á sus jefes, cometiere incendios ó depredaciones, los militares que hayan promovido tales atentados, y el de mayor empleo de los que cometieren el delito, incurrirán en la pena de muerte.
