° El cónyuge sobreviviente y los hijos menores o en su defecto, los padres legítimos o naturales del empelado u obrero retirado con pensión de jubilación por haber completado el tiempo de servicio a que se refiere los artículos anteriores, tendrán derecho, cuando este fallezca a percibir durante un año dicha pensión, siempre que comprueben que carecen de lo necesario, y que vivan a costa del pensionista al tiempo de ocurrir su fallecimiento.
