º . Rendimiento mínimo anual por préstamos otorgados por la sociedad a sus socios o accionistas o estos a la sociedad. Para efectos del impuesto sobre la renta, por el año gravable 2003, se presume que todo préstamo en dinero, cualquiera que sea su naturaleza o denominación, que otorguen las sociedades a sus socios o accionistas o estos a la sociedad, genera un rendimiento mínimo del 7.70%, de conformidad con el artículo 35 del Estatuto Tributario, modificado por el artículo 94 de la Ley 788 de 2002.
