Cuando en el personal del servicio activo no se halle el suficiente para integrar el respectivo Tribunal, el Ministro de Guerra, a petición del Juez, debe enviar a este la lista de los Oficiales y Suboficiales retirados normalmente, y que a su juicio pueden formar parte de los Tribunales, para los efectos del artículo 59 de este Código.
