Las apelaciones de los autos interlocutorios se sustanciarán por el Superior así repartido el expediente, el juez o magistrado ordenará que se corra traslado de él al Agente del Ministerio Público por un lapso de cinco días, y que en seguida se fije en lista por el término de cuatro. Vencido el término de la fijación en lista, dentro del cual pueden los interesados presentar sus alegatos, decidirá el superior.
