El militar que ponga mano a un arma ofensiva, o ejecute actos o demostraciones con tendencia a ofender a un superior en empleo o mando, será castigado por este solo hecho con la pena de seis a diez y ocho meses de prisión militar.

Si el ofendido fue re el jefe supremo de operaciones en campaña u otro Oficial que estuviere de facción, o mandando al ofensor en funciones del servicio, la pena será en todo caso la mayor.
