No aceptación de impedimento o recusación. Declarado infundado el impedimento o la recusación, se devolverá, el expediente al funcionario que se declare impedido o fue recusado. En el último caso, el recusante será, sancionada, en el mismo auto a multa hasta de cinco mil pesos a favor del Tesoro Nacional, si resulta ostensiblemente infundada la recusación. Si fuere el caso se ordenará; además, expedir las copias pertinentes para la investigación penal o disciplinaria a que hubiere lugar.
