El funcionario o empleado público que, fuera de los casos especiales previstos como delitos, o en otros artículos de este Código, con ocasión de sus funciones o excediéndose en el ejercicio de ellas, cometa o haga cometer acto arbitrario o injusto contra una persona o contra una propiedad, será privado de su empleo, y se le aplicará una multa de diez a quinientos pesos.
