La constitución de parte civil podrá intentarse en cualquier estado del proceso, antes de que el negocio haya entrado al despacho del juez o magistrado para dictar sentencia de segunda instancia.

En los procesos que se ventilen en una sola instancia, deberá intentarse antes de que el negocio haya entrado al despacho del juez o magistrado para dictar sentencia.
