Art. 41. Cuando se proceda por infracción del inciso 1°, Caso 1°, Artículo 2°, el Juez examinará si el hecho imputado está erigido en delito conforme al Código Penal. Si no estuviere, así lo declarara en un auto que se publicará en el periódico oficial del Departamento. Contra esta resolución no hay otro recurso que el de queja.
