Si no se hace oposición, ni tampoco se ejercita el derecho de compra, o si aquélla se declara infundada, el Juez dispone la venta de la cosa en pública subasta en los mismos términos señalados para el juicio ejecutivo; pero en la licitación sólo son admisibles posturas que cubran, cuando menos, el total del avalúo.
