El que de manera pública y directa incite a otro u otros a cometer un delito determinado, está sujeto por este solo hecho a la pena de arresto de dos meses a un año, y a la de multa de cincuenta a mil pesos, siempre que tal acción no esté prevista como delito de mayor gravedad en otra disposición.
