°. Naturaleza del contrato . El contrato celebrado entre el prestador a que hace referencia el artículo 1° del presente decreto y el usuario, será de hospedaje. En consecuencia, la relación contractual entre el prestador y el usuario del servicio de hospedaje se regirá por la Ley 300 de 1996, la Ley 1101 de 2006 y sus decretos reglamentarios y las normas pertinentes del Código de Comercio, sin que le sean aplicables de manera alguna las normas atinentes al arrendamiento de vivienda urbana.
