Finalmente, es indigno de suceder el que, a sabiendas de la incapacidad, haya prometido al difunto hacer pasar sus bienes o parte de ellos, bajo cualquier forma, a una persona incapaz.

Esta causa de indignidad no podrá alegarse contra ninguna persona de las que por temor reverencial hubieren podido ser inducidas a hacer la promesa al difunto ; a ménos que hayan procedido a la ejecucion de la promesa.
