El fiscal, para los asuntos de que conocen los Consejos de Guerra Superiores y Verbales, será un oficial superior. En los demás casos, el fiscal podrá ser un oficial superior o Capitán. En ningún caso podrá ser fiscal un oficial de menor graduación o menos antiguo que el sindicado o presuntos sindicados.
