Aplicación de Guías Ambientales. A partir de la suscripción del Contrato de Concesión para la formalización minera y hasta que los pequeños mineros obtengan la respectiva Licencia Ambiental, deberán aplicar las guías ambientales expedidas por el Ministerio de Ambiente y Desarrollo Sostenible, caso en el cual no habrá lugar a proceder respecto de los pequeños mineros mediante la medida prevista en el artículo 161 de la Ley 685 de 2001, sin perjuicio de las acciones administrativas ambientales que deban imponerse por parte de las autoridades ambientales competentes, en caso de daño ambiental.
