Carga de la prueba . En los procedimientos administrativos agrarios de extinción del derecho de dominio privado, clarificación de la propiedad, deslinde de tierras de la Nación y recuperación de baldíos indebidamente ocupados, la carga de la prueba corresponde a los particulares, pero el Incoder podrá de oficio decretar o practicar las pruebas que considere necesarias. Igualmente corresponde a los particulares probar la fuerza mayor y el caso fortuito cuando fueren alegados. (Decreto número 1465 de 2013, artículo 11)
