Se eximirá de toda pena por delito previsto en elArtículo precedente:

Al testigo que si hubiere dicho la verdad, se habría expuesto él mismo o habría expuesto a un pariente próximo a un peligro grave para su libertad o su honor.

Al que habiendo declarado ante la autoridad que lo interroga su nombre y estado, no debiera haber sido interrogado como testigo; o tenía derecho a que se le hiciera saber que podía abstenerse de declarar.

Pero si con el testimonio falso de una de estas personas se expone a un tercero a un proceso o condenación, se impondrá la pena legal disminuida de la mitad a una tercera parte.
